By accessing and using Stamperly ("Service"), you accept and agree to be bound by these terms. If you do not agree, please do not use this Service.

2. Description of Service

Stamperly is a digital loyalty card platform that enables businesses to create and manage stamp-based loyalty programs. Customers can save digital loyalty cards to Apple Wallet or Google Wallet.

3. User Accounts

Account registration is required for certain features. You agree to:

• Provide accurate and complete information when creating your account
• Keep your account details up to date
• Not share your login credentials with others
• Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree to use the Service lawfully and not to:

• Engage in any illegal or unauthorized activities
• Violate any applicable laws or regulations
• Infringe on the rights of others
• Transmit harmful or malicious code
• Attempt to gain unauthorized access to the Service

5. Payment and Billing

Paid features require a subscription. All plans start with a 14-day free trial. Fees are billed monthly and are non-refundable except as required by law. You can cancel your subscription at any time.

6. Data Retention

If you cancel your subscription, your data is retained for 30 days. After 30 days, all data including customer records, loyalty cards, and analytics are permanently deleted. You can export your data at any time before deletion.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy, which governs how we collect and use your information.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Stamperly and protected by international copyright, trademark, and other intellectual property laws. Your business content (logos, card designs, customer data) remains yours.

9. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms. You may also terminate your account at any time through the dashboard settings.

10. Disclaimer

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Stamperly disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

Stamperly shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance.
